Terms of Service
Welcome to Kilowatt Texas. These Terms of Service ("Terms") govern your use of kilowatttexas.com and any services we provide (collectively, the "Service"). By using the Service, you agree to these Terms. If you don't, please don't use the Service.
The short version: Our tools are free and informational. We're not your electricity provider — we help you find one. The savings numbers we show are estimates, not guarantees. Switching is your choice. If you have questions or want a human, just email us.
1. Who we are, what we do
Kilowatt Texas operates a website that provides free tools and information about Texas electricity rates and plans. We help Texans in deregulated markets understand their bills and compare plans from licensed Retail Electric Providers (REPs).
We are not a Retail Electric Provider. We do not generate, transmit, distribute, or sell electricity. We do not control electricity rates or terms. We provide informational tools and, with your consent, may help connect you with a licensed REP that you choose.
2. Acceptance of these Terms
By accessing or using the Service, you confirm that:
- You are at least 18 years old.
- You have the authority to enter into agreements (such as electricity service contracts) on behalf of the account holder if you're acting for someone else.
- You agree to these Terms and our Privacy Policy.
3. The tools are informational, not advice
Our bill calculator, plan comparison, usage estimator, and bill diagnostic tools are informational. They use:
- Public data from third-party Texas energy data sources (which we believe to be accurate but cannot guarantee).
- Standard assumptions and averages that may not match your exact situation.
- Real-time API data that may be delayed or temporarily inaccurate.
Estimated savings figures are estimates, not guarantees. Your actual savings depend on many factors including your specific usage, the rate plan you choose, TDU charges, taxes, and contract terms. We make no promise or representation that you will save any specific amount, or that you will save anything at all.
Always read the Electricity Facts Label (EFL) and Terms of Service of any electricity plan before signing up. Those documents — not our tools — control your contract.
4. Switching electricity plans
If we help you switch electricity providers:
- The actual electricity service contract is between you and the licensed REP you choose. Not between you and Kilowatt Texas.
- You're responsible for reviewing the REP's EFL and terms before agreeing.
- You're responsible for any early termination fees, contract obligations, or other charges from your current or new REP.
- We don't guarantee that switching will result in savings. Markets change.
5. Calls, texts, and TCPA consent
When you submit a contact form requesting a call or text, you're giving us your prior express written consent under the Telephone Consumer Protection Act (TCPA) to contact you at the phone number you provided about Texas electricity plans — including by automated dialing systems and prerecorded messages. Standard message and data rates may apply.
Your consent is not a condition of any purchase, and you can opt out at any time by replying STOP to a text, asking us during a call, or emailing [email protected].
6. Acceptable use
You agree to use the Service for personal, non-commercial purposes. You agree not to:
- Scrape, copy, or systematically extract data from the Service.
- Reverse engineer or attempt to extract our source code or backend logic.
- Use the Service to send spam, phishing attempts, or any unlawful content.
- Submit false or misleading information through our forms.
- Interfere with the Service's operation or attempt to gain unauthorized access.
7. Intellectual property
The Service, including its tools, design, branding, and content, is owned by Kilowatt Texas. You may use the Service for its intended purpose. You may not copy, modify, or republish the Service or any substantial portion of it without our written permission.
Provider names, plan names, and rate data displayed in our tools are the property of their respective owners and are used here for informational purposes.
8. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
We don't warrant that:
- The Service will be uninterrupted, error-free, or 100% accurate.
- Any rate, savings estimate, or plan information is current or applicable to your situation.
- Switching providers through our service will save you money.
9. Limitation of liability
To the maximum extent allowed by law, Kilowatt Texas and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed $100 USD or the amount you paid us in the prior 12 months — whichever is greater.
You acknowledge that the Service is free, and that we accept no responsibility for the accuracy of third-party data, the actions of licensed REPs, or the outcome of any electricity plan you choose.
10. Indemnification
You agree to defend, indemnify, and hold harmless Kilowatt Texas from any claims, damages, or expenses arising from your use of the Service or your breach of these Terms.
11. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.
Before filing any legal action, you agree to attempt to resolve the dispute by contacting us at [email protected] and giving us 30 days to respond.
12. Changes to these Terms
We may update these Terms occasionally. The "Last updated" date will reflect the most recent change. Continued use of the Service after changes constitutes acceptance. If a change materially affects your rights, we'll highlight it on the Site.
13. Termination
We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service at any time.
14. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms and our Privacy Policy together represent the entire agreement between you and Kilowatt Texas regarding the Service.
