Privacy Policy
Kilowatt Texas ("we," "our," or "us") cares about your privacy. This policy explains what information we collect when you use kilowatttexas.com (the "Site"), how we use it, who we share it with, and what rights you have. We try to be straightforward — no legalese fog.
The short version: We collect what you give us through the tools and forms on this site (name, phone, ZIP, your kWh usage and current rate). We use it to help you find a cheaper Texas electricity plan. We don't sell your data to third parties. We don't track you across the web. If you want your data deleted, just email us.
1. Who we are
Kilowatt Texas is a Texas-focused energy advisory service that operates the website at kilowatttexas.com. We help Texans in deregulated electricity markets compare retail electricity providers (REPs), understand their bills, and switch to cheaper plans when it makes sense.
We are not a Retail Electric Provider (REP). We do not generate, transmit, or distribute electricity. We help Texans connect with licensed REPs.
2. Information we collect
Information you give us directly
When you use a tool or fill out a form on the Site, we may collect:
- Contact info: Name, phone number, and (sometimes) email address.
- Energy details: Your ZIP code, your current monthly kWh usage, your current electricity rate, and your current Retail Electric Provider if you tell us.
- Communication preferences: If you ask us to call or text you, we keep a record of that.
Information collected automatically
When you visit the Site, our hosting provider (Cloudflare) automatically logs basic information: your IP address, browser type, the pages you view, and the time of your visit. We use this to operate the Site, troubleshoot, and prevent abuse. We do not currently use Google Analytics, Meta Pixel, or any third-party tracking on the Site. If we add advertising tracking pixels in the future, this policy will be updated and we'll add a cookie banner.
Information we don't collect
- We don't collect Social Security numbers, financial account numbers, or government ID numbers — none of our tools need them.
- We don't collect data about your race, religion, sexual orientation, or political views.
- We don't knowingly collect any information from children under 13.
3. How we use your information
We use the information you give us to:
- Show you live Texas electricity rates and plan comparisons for your ZIP code.
- Calculate your bill and identify potential savings.
- Contact you by phone, text, or email if you've requested a callback or a free bill review.
- Help you enroll in a new electricity plan with a licensed Texas REP if you choose to switch.
- Improve our tools (in aggregate — we look at usage patterns, never individual user behavior).
4. Who we share your information with
We share limited information with the following types of parties, and only when necessary:
- Licensed Texas REPs: If you tell us you want to switch plans, we share what's needed to enroll you (your name, address, contact info) with the REP you've chosen — and only after your explicit consent.
- Service providers: Cloudflare (hosting), Google Workspace (email and lead storage). These vendors process data on our behalf and are contractually required to protect it.
- Legal requirements: If required by law, court order, or to protect rights or safety.
We do not sell your personal information to data brokers or advertising networks. We do not allow third parties to use your data for their own marketing.
5. TCPA and your communication consent
When you submit a form on this Site requesting that we call or text you, you're giving us prior express written consent under the Telephone Consumer Protection Act (TCPA) to contact you about Texas electricity plans at the phone number you provided — including by automated dialing systems and prerecorded messages. Standard message and data rates may apply.
Your consent is not a condition of any purchase. You can opt out at any time by:
- Replying STOP to any text message we send you.
- Telling us on the phone that you don't want to be contacted again.
- Emailing [email protected] with "unsubscribe" in the subject line.
6. Data retention
We retain your contact information for as long as you're actively engaged with us (e.g., you've contacted us within the last 24 months) or as required to comply with our legal obligations. After that, we either delete or anonymize the data. Aggregated, non-identifiable data may be retained indefinitely.
7. Your rights
You have the following rights regarding your personal information:
- Access: Ask us what data we have about you.
- Correction: Ask us to fix anything inaccurate.
- Deletion: Ask us to delete your data — we'll do it within 30 days unless we're legally required to keep it.
- Opt out: Stop receiving calls, texts, or emails from us at any time.
- Portability: Request a copy of your data in a portable format.
To exercise any of these rights, email [email protected]. We may need to verify your identity before fulfilling the request.
If you live in Texas, California, or another state with privacy laws
Texas residents have rights under the Texas Data Privacy and Security Act (TDPSA), effective July 1, 2024. California residents have rights under the CCPA and CPRA. The rights described above apply to you, plus you have the right to be free from discrimination for exercising them. To submit a request, use the email above.
8. Security
We use industry-standard safeguards including HTTPS encryption for all data in transit, restricted access to personal data within our team, and reputable cloud vendors (Cloudflare, Google Workspace) for storage. No system is 100% secure, but we work hard to make breaches unlikely.
9. Children's privacy
This Site is intended for adults (18+). We do not knowingly collect data from anyone under 13. If you believe a child has provided us with personal information, please email us and we'll delete it.
10. Changes to this policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top will reflect the most recent change. Material changes will be highlighted prominently on the Site. By continuing to use the Site after updates take effect, you accept the revised policy.
